Nonpayment, lease violations and possession

An unpaid balance is only one part of a nonpayment case. The lease, rent ledger, prior notices, tenant communications and property conditions can affect the claim. For a lease violation or a tenancy termination unrelated to unpaid rent, counsel first evaluates the available grounds and the documents needed to support them.

Representation may include preparing a notice, coordinating service, preparing a summary process case, responding to defenses and counterclaims, negotiating an agreement, and presenting the landlord’s evidence at a hearing or trial. The scope of work is determined for the particular matter.

Review the notice before filing

Massachusetts uses summary process to obtain a court order for possession. The tenancy generally must be lawfully terminated before the case begins. A notice to quit does not itself authorize removal of the tenant. Review Massachusetts notice to quit representation before relying on an old form or a notice prepared for another property.

Possession, payment or an agreed move-out

The practical objective may be recovering possession, resolving rent arrears or agreeing on a documented departure. RentalCounsel evaluates those options with the owner. When a tenant remains after a lease or notice ends, see counsel for Massachusetts holdover tenants.
