Identify the property and the legal ground

New Hampshire law distinguishes between property classifications and specifies grounds for terminating covered tenancies. The lease, use of the property and reason for termination should be evaluated before selecting a notice. A lease expiration or a proposed business change requires its own analysis; it should not be treated as interchangeable with a nonpayment case.

Demand, notice and court proceedings

For matters governed by RSA chapter 540, the required demand or eviction notice comes before the Landlord and Tenant Writ process. Counsel reviews the reason stated, applicable timing, service proof and the evidence supporting the owner’s position. A notice alone does not authorize a landlord to remove an occupant.
