Choose the notice for the actual tenancy

Before drafting, the office reviews the lease and amendments, the tenancy arrangement, the reason for termination, payment records and relevant communications. Subsidized housing, property conditions and other circumstances may change the requirements or the risks. A notice copied from another case can miss a material issue.

Nonpayment and required documents

For unpaid rent, a reliable ledger should identify the amounts claimed and how payments were applied. Counsel evaluates the applicable notice requirements, any required accompanying documents and the effect of the lease. The purpose is to prepare a supportable notice and plan the next step if the matter is not resolved.

Service and the next stage

Correct wording alone is not enough. Delivery, proof and the timing of a later case should be considered together. A notice does not remove the tenant or replace the court process. If the tenant remains after a lawful termination, the owner may need Massachusetts eviction representation.
