Tenant Will Not Leave? Massachusetts Holdover Tenant Counsel

Massachusetts landlord counsel when a tenant remains after a lease, notice or agreed move-out date. Review possession options with RentalCounsel: (978) 702-9231.

A tenant remains after the lease ends, a notice expires or an agreed departure date passes. Before taking another step, the landlord needs to know what that event means for this particular tenancy. RentalCounsel assists Massachusetts residential owners with holdover and possession disputes.

What ended, and what happened afterward?

The first review considers the lease term, renewals, termination notice, any move-out agreement and communications between the parties. Payments accepted after a relevant date and later agreements may affect the analysis. The office evaluates whether the tenancy was properly terminated and what claims or defenses could arise.

A date is not an eviction order

Even where the landlord has a right to possession, a tenant’s continued occupancy generally requires lawful court process and enforcement. Changing locks, removing belongings or cutting services can create additional problems. Counsel can assess whether a summary process action is appropriate, whether an existing judgment can be enforced, or whether further notice is needed.

Negotiate a documented departure

In some matters, an agreement can address the move-out date, keys, payments and other disputed terms. The value of an agreement depends on its wording and how it can be enforced. RentalCounsel assists with negotiations and documentation while evaluating the owner’s litigation options.
